Terms of Service

The App is available exclusively to:

• Current residents of The Fairways in Glenn Dale, Maryland who have successfully completed the identity and residency verification process; and
• Authorized moderators and administrators designated by the App's operators.

You must be at least 18 years of age to register for and use the App. By registering, you represent and warrant that you meet these eligibility requirements.

When you register for an account, you agree to:

• Provide truthful, accurate, and complete information, including your name, email address, phone number, home address, and proof of residency.
• Maintain the accuracy of your registration information and promptly update it if your circumstances change (for example, if you move out of The Fairways).
• Keep your account credentials confidential and not share your login information with any other person.
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account. Providing false or misleading registration information is grounds for immediate account suspension or termination.

You agree to use the App only for its intended purpose: reporting suspicious activity and incidents, receiving neighborhood safety alerts, and communicating with verified residents in a safe and respectful manner.

The following conduct is strictly prohibited:

• Harassment or threats: targeting, intimidating, or threatening any individual or group.
• False reporting: submitting incident reports that you know to be false, misleading, or fabricated.
• Impersonation: misrepresenting your identity or impersonating any person, resident, official, or organization.
• Spam: sending unsolicited, repetitive, or irrelevant messages or reports.
• Illegal content: posting, uploading, or sharing content that violates any applicable law, including content that is defamatory, obscene, or that infringes on the rights of others.
• Misuse of emergency alerts: triggering, requesting, or encouraging emergency alerts for non-emergency situations.
• Unauthorized access: attempting to access accounts, systems, or data that you are not authorized to access.

Violation of these rules may result in immediate account suspension or permanent removal from the platform.

You are solely responsible for the content you submit to the App, including incident reports, comments, photographs, and videos. By submitting content, you represent that:

• The content is accurate to the best of your knowledge.
• You have the right to share the content.
• The content does not violate any applicable law or these Terms.

By submitting content, you grant us a non-exclusive, royalty-free license to store, display, and share that content with other verified residents and authorized personnel within the App for the purpose of neighborhood safety.

We reserve the right to review, moderate, remove, or retain any content at our discretion, including content that may be relevant to law enforcement investigations upon lawful request.

During account setup and alert-preference selection, you may separately choose to opt in to emergency SMS text alerts and automated voice-call alerts. Participation in these alert programs is entirely voluntary and separate from your general use of the App.

By opting in to SMS alerts, you acknowledge that:

• Message frequency varies based on community activity.
• Message and data rates may apply.
• You may opt out at any time by replying STOP to any alert message or by updating your preferences in the App.
• You may reply HELP to any alert message for assistance.

We reserve the right, in our sole discretion, to:

• Review any content submitted to the App.
• Hide, remove, or restrict access to content that violates these Terms or community standards.
• Suspend or permanently remove any account that violates these Terms, provides false registration information, or engages in conduct harmful to the community.
• Deny or revoke residency verification if we determine that eligibility requirements are not met or have changed.

Moderation decisions are final. If you believe a decision was made in error, you may contact us at [email protected] to request a review. We are not obligated to restore suspended or removed accounts.

We make reasonable efforts to keep the App available and operational, but we do not guarantee uninterrupted or error-free service. The App may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any feature or the App itself at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of service.

We do not guarantee that any alert, report, or message submitted through the App will result in a response from law enforcement, emergency services, or any other party. The App is designed to facilitate community awareness and communication among verified residents; it does not dispatch emergency services and does not have the ability to do so.

You acknowledge that reliance on the App as a substitute for contacting emergency services could result in delayed response to an emergency, and you agree that we are not liable for any such delay or its consequences.

To the fullest extent permitted by applicable law, SOS The Fairways Glenn Dale MD, its operators, moderators, and administrators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App or its content.

This includes, without limitation, damages for loss of data, loss of goodwill, personal injury, property damage, or any harm resulting from reliance on information or content posted through the App by other users.

Our total liability to you for any claim arising out of or related to these Terms or the App shall not exceed the amount, if any, that you have paid to us in the twelve months preceding the claim. Because the App is provided free of charge to residents, this amount is zero in most cases.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion.

We may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, no longer meet eligibility requirements, or if we discontinue the App.

Upon termination, your right to access the App ceases immediately. Provisions of these Terms that by their nature should survive termination — including limitations of liability, disclaimers, and content licenses — will continue to apply.

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify registered users through the App or by email.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
